Harvest Meadows Phase 1 Lot Reservation Agreement

Version 2026-10-21

1. What a reservation is

A reservation holds your place in line for up to two Phase 1 homesites in Harvest Meadows, Rexburg, Idaho, in the order reservations are received. It is not a purchase agreement and not an offer to buy or sell. No money is paid to reserve. You are not obligated to buy, and the developer of Harvest Meadows (the Developer) is not obligated to sell, until both sign a purchase agreement.

2. Up to two lots

You may hold up to two Phase 1 lots at a time. Lots you have reserved and lots under contract both count toward the two.

3. Lots, plans and prices are preliminary

Lot numbers, sizes, boundaries, the street layout, prices, plans and timing are preliminary until the final Phase 1 plat is recorded, and they may change. If a lot you have reserved changes materially or is removed, the Developer will offer you the closest comparable lot that is available, or your reservation of that lot ends.

4. The milestone and your earnest money deposit

The Milestone is reached when the final Phase 1 plat has been recorded and the Developer is ready to accept purchase agreements on Phase 1 lots. When it is reached, we will send you a notice by email at the address you give us. From the day that notice is sent, you will have 10 business days to sign the Developer's purchase agreement for each lot you want to keep and to deliver $1,000 in earnest money for that lot to the title company named in the purchase agreement. Your notice will say exactly where and how to deliver it. Smith Robinson Real Estate Two70 does not hold reservation money, and no earnest money is accepted before a purchase agreement is signed.

Your deadline is 5:00 pm Mountain Time on the 10th business day after the day the notice is sent. The day the notice is sent does not count. Business days are Monday through Friday, except U.S. federal holidays.

5. If the deposit is not made in time

If the signed purchase agreement and the earnest money for a lot have not been received by your deadline, your reservation of that lot ends at the deadline without any further notice. Unless the title company confirms that it received them by the deadline, the lot is released to the next person on the waiting list one business day after the deadline.

6. The waiting list

You may join the waiting list for a lot that is already reserved, or for any Phase 1 lot that becomes available. When a reserved lot is released, it goes to the earliest entry on the waiting list for that lot or for any lot, in the order entries were received. Anyone already holding two lots is skipped, and so is the person whose reservation of that lot has just ended. When a lot comes to you from the waiting list, we will send you a notice. If the Milestone has already been reached, your 10 business days start on the day that notice is sent.

7. Confirming your reservation

Rick Robinson or Grant Smith will call you to confirm each reservation. The Developer may cancel a reservation that cannot be confirmed, for example one made with contact details that do not reach you.

8. Changing your mind

You may cancel a reservation or leave the waiting list at any time, using your private reservation link or by telling Rick Robinson or Grant Smith. A cancelled lot is released to the waiting list.

9. Notices

We send notices by email to the address you give us, and we may also call or text you. Please keep your email address current. A notice is sent when we send the email.

10. Reservations are personal

A reservation cannot be sold, assigned or transferred.

11. The Developer's rights

Until a purchase agreement is signed, the Developer may pause or end the reservation program, withdraw any lot from sale, or decline any reservation. If that happens, the affected reservations end and no one owes anyone anything because of this agreement.

12. Who represents whom

Smith Robinson Real Estate Two70, a team of Real Estate Two70 (Rick Robinson, Designated Broker), represents the Developer in the sale of Harvest Meadows lots. You are welcome to be represented by your own real estate agent. Rick or Grant will give you the Idaho Real Estate Commission's agency disclosure brochure when they first speak with you about a lot, and always before you sign a purchase agreement.

13. Signing electronically

You agree to sign this agreement electronically. Checking the box and typing your full name is your signature. We record the date and time, the version of this agreement, a fingerprint of its exact text, and the internet address and browser you signed from. You can print or save this agreement from the confirmation page, and the copy at the link in your confirmation never changes.

14. Equal housing opportunity and governing law

Harvest Meadows homesites are offered without regard to race, color, religion, sex, disability, familial status or national origin. This agreement is governed by Idaho law.
